1. ACCEPTANCE OF TERMS

Welcome to Mara-Amara brand, web-site mara-amara.com By using our website and purchasing our products, you fully accept these Terms and Conditions of Service. If you do not accept these terms, please do not use our service.

Access to the site and placing an order constitute full and unconditional acceptance of these terms.

2. SERVICE DESCRIPTION

Mara-Amara offers apparel and posters featuring original surreal and psychedelic art graphics.

Business model: Print-on-Demand

Our products are made to order using print-on-demand technology through our partner Printify. This means that:

  • Each item is printed and produced specifically for you after order confirmation
  • We do not maintain physical inventory
  • Production times are 3-7 business days
  • Each product is unique and customized

Production partners: We use Printify and its network of certified production centers located in Europe, United States and other countries to ensure quality and optimal delivery times.

3. DATA SHARING WITH PRINTIFY

IMPORTANT: For the production and shipping of your orders, we share your personal data with:

Printify and production partners:

  • First and last name
  • Complete shipping address
  • Phone number (for carrier)
  • Email (for shipping notifications)
  • Order details (product, size, graphic)

Carriers and shippers:

  • Data necessary for delivery
  • Customs information for non-EU shipments

4. ORDERS AND PAYMENTS

4.1 Order confirmation:

  • All prices are in Euro (EUR) and include VAT where applicable
  • Orders are confirmed upon payment
  • You will receive a confirmation email with order details

4.2 Payment methods:

  • We accept payments through the methods indicated at checkout
  • Payments are securely managed by Shopify Payments
  • We do not store credit card data

4.3 Prices and availability:

  • We reserve the right to modify prices at any time
  • We reserve the right to refuse or cancel orders in case of:
    • Obvious pricing errors
    • Technical issues
    • Suspected fraud
    • Product unavailability

4.4 Invoicing:

  • We issue electronic invoices for all orders
  • For business invoices, enter VAT number at checkout
  • Invoices are available in the account area

5. PRODUCTION AND TIMING

5.1 Production times:

  • 3-10 business days from payment confirmation
  • Production starts immediately via Printify
  • Orders cannot be modified or canceled after 24 hours from confirmation

5.2 Customization:

  • Each product is printed with the graphic you chose
  • Carefully verify size, color and graphic before ordering
  • We do not accept modifications after production starts

5.3 Quality control:

  • All products are checked before shipping
  • Quality standards certified by Printify partners

6. SHIPPING AND DELIVERY

6.1 Shipping times:

After production, estimated delivery times are:

  • Italy: 6-12 business days
  • Europe (EU): 12-20 business days
  • Europe (non-EU): 12-20 business days
  • Rest of world: 20-30 business days

 

6.2 Tracking:

  • You will receive email with tracking number when order ships
  • You can monitor shipping via the provided link

6.3 Carriers:

  • We use reliable carriers selected by Printify
  • Carriers vary by destination to optimize time and costs

6.4 Shipping costs:

  • Automatically calculated at checkout
  • Based on destination, weight and dimensions

7. NON-EU SHIPMENTS: CUSTOMS DUTIES AND TAXES

IMPORTANT FOR NON-EU CUSTOMERS:

7.1 Countries affected: United Kingdom, Switzerland, Norway, United States, Canada, Australia, and all countries outside the European Union.

7.2 Customs duties and taxes:

  • Any customs duties, local VAT, import taxes and clearance fees are entirely the responsibility of the recipient
  • These costs are NOT included in the product price or shipping costs
  • The amount varies based on the destination country and local regulations
  • The carrier or customs authorities will contact you for payment

7.3 Customer responsibility:

  • Check your country's customs regulations before ordering
  • Pay all required duties and taxes within the established timeframe
  • Collect the package within the time indicated by the carrier
  • Provide any documents required by customs

7.4 Uncollected orders: If you refuse the package or do not pay customs duties:

  • The package will be returned to sender
  • It will not be possible to obtain a refund
  • You may be charged return fees

7.5 Customs delays:

  • We are not responsible for delays caused by customs procedures
  • Clearance times vary by country
  • Contact local customs authorities for information

8. SHIPPING ADDRESS

8.1 Customer responsibility:

  • Carefully verify shipping address at checkout
  • Ensure address is complete and correct
  • Include phone number for carrier

8.2 Incorrect address:

  • We are not responsible for orders shipped to incorrect addresses provided by customer
  • Any re-shipments incur additional costs charged to customer
  • Contact carrier immediately if address is incorrect

8.3 Order not received: If you don't receive your order within expected timeframe:

  2. Contact carrier

9. RETURNS AND REFUNDS

9.1 Customized products: In accordance with Article 59, paragraph 1, letter c) of the Consumer Code (Legislative Decree 206/2005), customized products are excluded from the 14-day right of withdrawal.

9.2 Defective products: We accept returns and refunds only for:

  • Printing or manufacturing defects
  • Damage during shipping
  • Wrong product or size
  • Non-conformity with order

10. INTELLECTUAL PROPERTY

10.1 Copyright:

  • All graphics, designs, logos and content are the exclusive property of Mara-Amara
  • They are protected by copyright and intellectual property laws
  • Reproduction, distribution or commercial use without written authorization is prohibited

10.2 License:

  • Purchasing the product grants you a personal, non-exclusive and non-transferable license
  • You can use the product for personal use
  • You cannot:
    • Reproduce or copy the graphics
    • Resell or distribute the images
    • Use graphics for commercial purposes
    • Remove or modify trademarks

10.3 Violations: Violations of intellectual property rights may result in legal action and claims for damages.

11. LIMITATION OF LIABILITY

11.1 Color variations:

  • Colors may vary slightly (5-10%) from online images
  • Depends on monitor, printing and materials
  • Does not constitute product defect

11.2 Limited liability:

  • Our liability is limited to the order value
  • We are not responsible for:
    • Indirect or consequential damages
    • Loss of profits or opportunities
    • Delays caused by carriers or customs
    • Problems caused by incorrect information provided by customer

11.3 Force majeure: We are not responsible for non-performance caused by events beyond our control (natural disasters, wars, pandemics, strikes, etc.).

12. PRIVACY AND PERSONAL DATA
